Insight: Three lawyers ask U.S. Supreme Court: Why here?

(Reuters) - For more than three decades survivors of human rights abuses in foreign countries have turned to U.S. federal courts to seek justice. On Monday the U.S. Supreme Court hears a case that could make that impossible.

The case pits a Nigerian widow against a multinational oil company. Esther Kiobel and others say Royal Dutch Petroleum (Shell) helped the Nigerian government commit human rights violations against her husband, who was executed in 1995. Shell has denied the allegations and argues that cases involving foreign governments committing atrocities in their own countries do not belong in the U.S. court system at all.

That the justices are considering the sweeping question of whether an entire class of lawsuits can be heard in the United States can be traced to briefs filed by three lawyers whose clients aren't even involved in the case.

How their briefs came to be sheds light on one of the most closely watched cases before the Supreme Court this term and shows how the efforts of private lawyers pursuing a public policy goal can have momentous consequences.

A ruling against Kiobel could wipe out lawsuits pending against companies such as Exxon Mobil Corp, Rio Tinto Plc and Nestle, which are accused by private plaintiffs of helping governments violate human rights in Indonesia, Papua New Guinea and Ivory Coast, respectively.

Esther Kiobel's husband, Barinem Kiobel, was arrested in 1994 along with Nobel Peace Prize nominee Ken Saro-Wiwa and others. They had spoken out against the government's violent suppression of environmental activists who opposed Shell's oil and gas drilling in Nigeria. Kiobel was found guilty of murder by a Nigerian military court in a trial that the U.S. State Department said lacked due process, and he was hanged in Port Harcourt, Nigeria, in 1995.

With no recourse in Nigeria, Esther, who had received asylum in the United States, filed a lawsuit in federal court in New York alleging among other things that Shell cooperated with the Nigerian military, resulting in crimes against humanity. She relied on a 200-year-old U.S. law called the Alien Tort Statute. (For a history of the Alien Tort Statute, click on [ID:nL1E8KSKLE].) While the case was under way, Shell won a ruling in September 2010 from the influential 2nd U.S. Circuit Court of Appeals that said Shell could not be held liable under the statute because it was a corporation. It was a major shock to human rights lawyers, who had brought more than 100 such cases against corporations in the previous two decades.

TEAMING UP AGAIN

The ruling quickly caught the attention of John Bellinger, an attorney at the law firm Arnold & Porter. In a series of interviews with Reuters, Bellinger, 52, discussed his actions over the subsequent 18 months. He stressed that he was speaking in a private capacity rather than as a representative of his clients in the Kiobel case.

Bellinger believed Kiobel's lawyers were likely to petition the Supreme Court. Sure enough, in October 2011 the court agreed to take the case on the narrow question of whether corporations could be held liable under the statute.

Bellinger, who had been State Department legal adviser in the Bush administration, had bigger ideas. He wanted to present the court with arguments he had heard from foreign governments while he was at the State Department. Back then, Australia, Britain, Canada and others had protested when cases were brought under the Alien Tort Statute. They argued that U.S. courts had no business judging events that took place on foreign soil.

When the Supreme Court accepted the Kiobel case, Bellinger started emailing and calling governments that had opposed previous Alien Tort Statute cases to see whether they wanted to file a brief and whether they already had legal representation. But none of those he contacted were ready to commit, leaving him with no one to represent.

In November last year, Bellinger called Shell's lawyer, Kathleen Sullivan, who had been one of his professors at Harvard Law School. Sullivan, who declined to comment for this story, was preparing to argue the question that was before the Supreme Court at the time: whether the statute applied to corporations. Bellinger says she mentioned to him that former U.S. Solicitor General Paul Clement was writing a brief for IBM in support of Shell. IBM is one of dozens of corporations that are defendants in another case, brought by South Africans who suffered abuses under apartheid.

Clement, a 46-year-old conservative wunderkind, has argued more than 50 cases before the nation's top court. In late 2011 he was working on some of the nation's highest-profile cases, including defending Arizona's immigration law and a federal law that defines marriage as a union between a man and a woman.

Clement and Bellinger had worked together on an Alien Tort Statute case when Clement was solicitor general and Bellinger was at the State Department. When they spoke, the two lawyers decided to team up again. "Paul agreed," said Bellinger, "we could track a number of the issues we'd argued in government."

They divvied up the work. To build their case, Bellinger sought to document instances where foreign governments had complained about the statute. Clement's job was to look at the big picture.

In an interview, Clement said he saw two issues lower courts were grappling with. One was Bellinger's concern about whether the statute applied to cases where abuses were committed in foreign countries. The other was whether helping a foreign government commit an abuse, rather than committing the abuse directly, was covered by the statute. Only the 2nd Circuit's Kiobel decision had brought up the new question of whether a corporation, rather than an individual, could be held liable under the statute. It was almost as if the Supreme Court was looking at the wrong question, Clement said.

Like Bellinger, Clement agreed to speak only in a private capacity and not as a representative of his clients in the ongoing litigation.

The two lawyers said they decided they needed to marshal a much broader argument than the one the Supreme Court had asked for in Kiobel. Bellinger spent December 2011 reaching out to clients of Arnold and Porter who were past, current or potential future targets of lawsuits under the Alien Tort Statute.

In February this year they filed their brief on behalf of BP Plc, Caterpillar Inc, ConocoPhillips, General Electric Co, Honeywell International Inc and IBM. They argued that the Alien Tort Statute does not cover events that took place in foreign countries, nor does it apply to those who help others commit abuses, only those who commit abuses themselves. None of the six companies would comment for this story.

Jack Goldsmith, another lawyer who had worked in the Bush administration, filed a similar brief on behalf of Chevron. Goldsmith declined to talk about the pending litigation.

CHANGING THE QUESTION

On a crisp morning in late February, Paul Hoffman, a veteran human rights advocate, stood before the Supreme Court to argue the case for Kiobel. Some 16 years earlier, Hoffman had brought a landmark lawsuit under the Alien Tort Statute against oil company UNOCAL over abuses in Myanmar, which settled in 2005 for an undisclosed sum. Since then, bringing lawsuits against corporations had come to define his career.

Hoffman had hardly opened his mouth, however, when Justice Anthony Kennedy interrupted with a question that had nothing to do with corporate liability but rather to do with the reach of U.S. courts. Justice Samuel Alito jumped in next: "What business does a case like that have in the courts of the United States?" Then Chief Justice John Roberts joined the fray. The justices wanted to know if U.S. courts had any role in adjudicating events that took place overseas. Hoffman was under assault and struggled to get back to the question of corporate liability.

Bellinger, sitting two rows back in the public gallery, smiled. The justices were interested in his argument.

Just how interested became clear a few days later. The following Monday, Bellinger got a message on his BlackBerry. The court had asked the parties to come back and argue a new question: whether, and under what circumstances, the Alien Tort Statute applied to events on foreign soil. "It was a stunner," he said.

Clement was similarly surprised. "We didn't file the brief imagining that they were going to ask for reargument," he said. "We filed the brief thinking if the court said something favorable it would help our clients in lower courts."

When the Supreme court seeks a second round of oral arguments, it can portend a significant ruling. Brown v. Board of Education, the landmark 1954 case that ended segregation in public schools, was decided after reargument. In 2009 a second round of arguments in Citizens United v. Federal Election Commission was followed by a major decision on political spending by corporations and unions.

The court's decision to consider the wider question could have a major impact. As of August this year, there were 36 claims against corporations under the Alien Tort Statute. If the court had ruled for Shell on the narrower question - that the statute does not apply to corporations - 20 of those cases could be dismissed. However, those 20 cases could be changed to name individual corporate officers rather than the corporations as defendants. This would mean the cases could go forward. And while they would be harder to win, they would still create negative publicity. "It wouldn't stop the next wave of litigation," said Bellinger.

If, on the other hand, the court rules broadly for Shell, deciding that the statute does not apply to events on foreign soil, 29 of the current cases would likely be dismissed. The only cases that would remain are seven in which the alleged abuses took place on U.S. soil.

Earlier this month, Hoffman held a final strategy meeting at New York University Law School. His casual chinos and sneakers belied the seriousness of Monday's reargument for the survivors of human rights abuses. A ruling against the plaintiffs on the grounds that the events happened overseas would, he said, "rip the guts" out of the Alien Tort Statute.

Five Big Changes In The iOS 6 App Store (And What Developers Should Do)

appstoreiconIs the new iOS App Store a step forward or step back for mobile app developers, users, and the app economy overall? Some developers are complaining that since the introduction of the Chomp-inspired App Store redesign in iOS 6, sales have noticeably dropped. Others say the changes are good for indie developers. Whichever side of the coin you're on, there are a number of reasons why developers are feeling the effects. In the new iOS App Store, the user interface now encourages a slower search method (flipping through cards, not scrolling through vertical lists), less attention is given to new releases and category-based search as "Genius" recommendations are given a higher billing, App Store SEO (ASO) is basically a black box that no one seems to understand, and more.

Forums - UN wants massive global taxes on everything

09-28-12 08:05 PM

Quote from Grandluxe:

EXCLUSIVE: As the UN opens its General Assembly session, it is already thinking up new global taxes
By George Russell
Published September 27, 2012

A 1 percent tax on billionaires around the world. A tax on all currency trading in the U.S. dollar, the euro, the Japanese yen and the British pound sterling. Another tiny tax on all financial transactions, including stock and bond trading, and trading in financial derivatives. New taxes on carbon emissions and on airline tickets. A royalty on all undersea mineral resources extracted more than 100 miles offshore of any nations territory.

These latest global tax proposals have received various forms of endorsement at U.N. meetings over the spring and summer, and will be entered into the record during the 67th U.N. General Assembly session, which began this week.

The United Nations is finding new and innovative ways to create global taxes that would transfer hundreds of billions, and even trillions, of dollars from the rich nations of the world especially the U.S. to poorer ones, in line with U.N.-directed economic, social and environmental development.

An Enamel Badge Is the Perfect Award to Commend Unique ...

When you are in school what greater honour is there than to be promoted to Head Girl, Head Boy, House Captain or Prefect? It is an extremely great honour that comes with much responsibility and these important roles are chosen very carefully. As a way to commend these unique individuals, and to make them recognizable in their schools, an enamel badge is the perfect award. They will wear these beautifully made, durable badges with pride on the lapels of their blazers and keep them forever, possibly to one day inspire their children and grandchildren to follow in their footsteps.

These rewards distinguish a group of leaders from their peers, making them visible as they walk down the corridors in between classes, but an enamel badge can also signify being a part of a team. Schools have many teams of hardworking pupils from football to rugby and netball to rounders, and decorating the team with their own distinct enamel badge expresses their unity. Unique enamel badges can also be awarded to Team Captains, as well as Bronze, Silver and Gold awards for annual sports day events.

But why stop with sports colors? There are many other important roles and teams that deserve the high honour of brandishing a decorative badge, such as being a part of the art or chess club, the choir and school band. Also, to motivate a sense of citizenship within their school, enamel badges can be awarded to those individuals that exceptionally apply themselves, for example, ?Perfect attendance?, ?Most helpful? or ?Most improved?.

Schools and the houses within, all have a coat of arms or some kind of insignia that is displayed on the breast pockets of blazers and school ties. These designs on an enamel badge, something long-lasting and meaningful that can be kept forever, made available to all pupils for purchase would be a fantastic way for the school to raise some money, and also give everyone an opportunity to display their citizenship and pride for their school. Everybody likes to feel like they belong, whether it is the cricket team or simply signifying what school they attend and the house they belong to.

Your enamel badges can be awarded either in an exquisite leather box with satin lining, a card box for a less expensive but still a very elegant presentation, or on a backing card, all personalized with your school?s logo. These packaging options help to signify the honour, importance and distinction of being bestowed with a wearable trophy that will become a cherished keepsake.

Claire Appleton founded Insignia Ltd in 1981 and continues to run it as Managing Director today. Insignia are the UK?s leading supplier of Enamel Badges and have extensive experience in supplying branded school products and providing fresh ideas for school citizenship and fundraising activities.

Gout is one of the most common forms of inflammatory arthritis, affecting nearly 4% of adult Americans. Newly approved guidelines that educate patients in effective methods to prevent gout attacks and provide physicians with recommended therapies for long-term management of this painful disease are published in Arthritis Care & Research, a peer-reviewed journal of the American College of Rheumatology (ACR).

Uric acid is produced by the metabolism of purines, which are found in foods and human tissue. When uric acid levels increase, crystals can form and deposit in joints, causing excruciating pain and swelling typical of an acute gout flare. Doctor-diagnosed gout has risen over the past 20 years and now affects 8.3 million individuals in the U.S., according to a July 2011 study published in Arthritis & Rheumatism. Medical evidence suggests that the increased prevalence of elevated uric acid levels (hyperuricemia) and gout may be attributed to such factors as hypertension, obesity, metabolic syndrome, type 2 diabetes, and the extensive treatment with thiazide and loop diuretics for cardiovascular disease.

"Acute gout attacks can be debilitating and adversely affect patients' quality of life," says lead investigator John D. Fitzgerald, MD, PhD, Acting Rheumatology Division Chief at the University of California, Los Angeles (UCLA). "In order to improve patient care, the ACR funded this collaborative effort among U.S. researchers to produce guidelines, outlining pharmacological therapies and non-drug treatments to manage gout."

Dr. Fitzgerald and fellow co-leaders Drs. Robert Terkeltaub (senior and corresponding author, from the VA and UCSD system), Dinesh Khanna and Puja P. Khanna (from the University of Michigan and VA system) reviewed medical literature from the 1950s to the present. A task force panel including seven rheumatologists, two primary care physicians, a nephrologist, and a patient representative then ranked and voted upon recommendations to create the two-part ACR gout guidelines.

Part I guidelines focus on the systematic non-pharmacologic and pharmacologic therapeutic approaches to hyperuricemia and include:

  • Educating patients on diet, lifestyle choices, treatment objectives, and management of concomitant diseases; this includes recommendations on specific dietary items to encourage, limit, and avoid.
  • Treating patients with a xanthine oxidase inhibitor (XOI), such as allopurinol (Zyloprim), as first-line pharmacologic urate-lowering therapy approach.
  • Recommending that patients' urate levels be lowered to less than 6 mg/dL, at a minimum, to improve gout symptoms.
  • Suggesting that the initial dose of allopurinol be no greater than 100 mg/day, and less for patients with chronic kidney disease; followed by gradual increase of the maintenance dose, which can exceed 300 mg even in those with chronic kidney disease.
  • Consideration of HLA-B*5801 pre-screening of patients at particularly high risk for severe adverse reaction to allopurinol (e.g., Koreans with stage 3 or worse kidney disease, and all those of Han Chinese and Thai descent).
  • Prescribing combination therapy, with one XOI and one uriocosuric agent, when target urate levels are not achieved; pegloticase in patients with severe gout disease who to not respond to standard, appropriately dosed ULT therapy.

Part II guidelines cover therapy and prophylactic anti-inflammatory treatment for acute gouty arthritis. These guidelines recommend that physicians:

  • Initiate pharmacologic therapy within 24 hours of onset of acute gouty arthritis attack.
  • Continue ULT therapy, without interruption, during acute gout flares.
  • Use non-steroidal anti-inflammatory drugs (NSAIDs), corticosteroids, or oral colchicine as first-line treatment for acute gout, and combinations of these medications for severe or unresponsive cases.
  • Utilize oral colchicine or low-dose NSAIDs as the first-line therapy options to prevent gout attacks when initiating ULT, as long as there is no medical contraindication or lack of tolerance.

Dr. Fitzgerald concludes, "The ACR gout guidelines are designed to emphasize safety, quality of therapy, and to reflect best practice based upon medical evidence available at this time. Our goal is that these guidelines, along with educating gout patients in effective treatment, will improve adherence, quality of care and management of this painful and potentially chronically debilitating condition."

Industrial Maintenance Training at Your Site

Do you have a team of professionals who need to learn industrial maintenance? Perhaps you want to improve your team?s skills and efficiency. You may want to reduce the risks you are facing because your employees do not have the level of training they need. No matter what reason you have to obtain this type of advanced education, it can be one of the most important resources possible. It is quite possible for you to get the type of training and updated education necessary at a local facility or training center. On the other hand, you may want to have a company of experts come to your location to offer this type of education.

Why Your Site Matters

When you have industrial maintenance training at your own location, this does several key things for your organization. It may indicate that the specific topics covered and applications of information learned will apply directly to your organization rather than to a general audience. This means your employees are getting a more specific education as it relates to your organization. That means it relates better to your needs.

Secondly, it can increase productivity. Instead of having your key team members out of the office or off the floor for an extended period of time, the professionals come to you. Your employees can work around their educational program to keep up with the needs of the job. More so, there is no need to pay for drive time or other costs related to getting the training. This means you spend less to get this type of training overall.

What Type Is Available?

Before you get the process started, determine what type of education your team needs. You will find a wide range of programs available to help with most industrial and commercial needs. This includes topics such as practical energy, hydraulics, motor controls, electrical, mechanical and robotics. Your professionals may need to use various types of equipment for the job. However, you may not have a professional on hand in your organization to educate them. That is where these third-party companies come into play. Now, they can come to your organization, teach your employees about pneumatics and process controls and help your business to do better.

Industrial maintenance and upkeep, not to mention equipment training, is a critical component to maintaining and running your business. However, it does not have to cost you a lot of time or money to get the job done. Rather, simply turn to a local organization, schedule a time for the professional to come to your location and get your team up to date. That is all it takes to get everyone back on the same page working safely for you.

Pursuing Industrial Maintenance Alabama certification can really help your business grow and mature. The staff at http://atn.org will train you and your staff on how to maintain your site.

Netanyahu's cartoon bomb timed to make big impact

NEW YORK (Reuters) - The "Bibi bomb" was born of days of discussions between Israeli Prime Minister Benjamin Netanyahu and a brain trust of close advisers on how to make a powerful impact in yet another speech on Iran's nuclear program.

"The diagram made his address special," a senior official in Netanyahu's entourage said on Friday about the cartoonish drawing of a bomb the Israeli leader, who is nicknamed "Bibi," used at the U.N. General Assembly as a prop to illustrate what he sees as Iran's drive for an atomic weapon.

It may have raised a titter on Twitter, where the New Yorker magazine quipped, "if Wile E. Coyote ever gets hold of this, the Roadrunner is toast." But the graphic got what Israel was hoping for - attention.

Such a Looney Tunes analogy would not have been lost on Netanyahu, who was educated in the United States, and at least one of his top advisers, Ron Dermer, who was born there and immigrated to Israel.

But on the world stage at the U.N. General Assembly, Netanyahu took out a marker and dramatically drew a red line just below a label reading "final stage" to a bomb, in which Iran would be 90 percent along the path to having sufficient weapons-grade material.

"I tried to say something yesterday that I think reverberates now around the world," Netanyahu said at a meeting on Friday with Canadian Prime Minister Stephen Harper.

Iran denies allegations by Israel, widely believed to be the Middle East's only nuclear power, that it is enriching uranium in order to build a weapon.

"USEFUL TOOL"

So who was the father of the "Bibi bomb?"

The Israeli official would not say.

"He's got a small group of close advisers," the official said. "In different meetings, people throw out all sort of ideas. Ultimately, the prime minister makes a decision which ideas to accept."

The team met for days, proposing "countless drafts" and a decision was made that "by using the diagram, the people would get the message - people would understand", the official added, calling the drawing "a useful tool."

He said he did not know who actually drew the bomb or if it had been copied from a computer graphics program. And, as with any Netanyahu speech, it's unclear until the last moment what stays in and what is left out.

"He's making changes until the very end. He was making changes as he was being introduced in Congress last year," the official said about Netanyahu's address to a joint meeting of the U.S. legislature in May 2011.

Netanyahu has also done some public sketching in the past.

While he was finance minister from 2003 to 2005, Netanyahu illustrated the burden of Israel's bloated public sector on the economy by drawing stick figures of a thin man - private enterprise - carrying the weight of a heavy man on his back.

At a news conference in April, he used a tablet, projected onto a large screen, to draw a tree whose fruit and stability he said symbolized his government's achievements.

AUDIO-VISUAL AIDS AT THE U.N.

It is not the first time visual or audio props have been used to make a point at the United Nations.

During the 1962 Cuban missile crisis U.S. Ambassador to the United Nations Adlai Stevenson unveiled during a televised U.N. Security Council meeting photos taken by U-2 spy planes of Soviet missiles and launch pads on Cuba and dramatically confronted Soviet Ambassador Valerian Zorin with the charges.

In 1983, U.S. Ambassador Jeane Kirkpatrick played an audio recording of a Soviet interceptor pilot involved in the shooting down of Korean Airlines flight 007 over the Sea of Japan, which killed all 269 passengers and crew. Afterward, it was impossible for the Soviets to deny their involvement.

U.S. Secretary of State Colin Powell's February 2003 speech to the U.N. Security Council in which he presented intelligence about Iraqi leader Saddam Hussein's alleged nuclear, biological and chemical weapons programs was less successful.

Perhaps attempting to follow in Stevenson's and Kirkpatrick's footsteps, Powell's speech employed images, audio recordings, even a vial of white powder that was intended to look like enough anthrax to kill the entire U.S. Senate.

That speech, based on evidence now known to have been erroneous, did nothing to sway the skeptical French, Russians and Germans. They eventually forced the frustrated United States and Britain to abandon their efforts to secure a green light from the United Nations for the March 2003 invasion of Iraq.

In 2009, the late Libyan leader Muammar Gaddafi held up a copy of the U.N. charter and tossed it over his shoulder during a rambling 1-1/2 hour speech to the General Assembly. It was his first and last U.N. speech.

Also that year at the General Assembly, Netanyahu displayed a copy of the blueprints for the Nazi death camp Auschwitz to decry Iranian President Mahmoud Ahmadinejad's denial of the Holocaust.

Builders put home buyers into credit boot camp

(Reuters) - In the post-housing crash world, Kelly and Jeff Clark are the kind of people who are not supposed to be able to buy a house.

For a down payment, they had exactly nothing. Their credit scores were sub-par. But this Christmas, the Clarks will move from their rundown rental into a brand new, four-bedroom home in an amenity-loaded development outside of Lakeland, Florida. All without paying a dime.

The Clarks were able to qualify for a mortgage because their builder, Southern Homes, spent the summer putting them through a financial boot camp. Bigger home builders such as D.R. Horton Inc , Lennar and PulteGroup Inc are also offering sophisticated financial advice to prospective home buyers who would not normally qualify for loans.

These fiscal rehabs are one reason many builders are boosting sales, even though mortgage lending is tight. Pulte said in July that its financial program could help its sales for some time. On Monday, Lennar Corp said revenue from home sales rose 33 percent last quarter from the same quarter a year earlier. Orders for homes rose 44 percent, helped by the 25 percent increase in membership in its Homebuyers Club since last year.

Providing financial therapy solves a huge problem for the builders: How to sell to first-time home buyers when so many younger consumers are saddled with student debt and bad credit.

The financial advisors go by names such as "mortgage advisors," "credit advocates" or "loan officers." They help prospective customers create budgets and slash spending. Both D.R. Horton and Lennar also help out with "credit repair," the practice of analyzing credit reports to determine the best strategies for raising scores as quickly as possible.

The buyers then get mortgages from the builders' own, in-house lending arms.

But consumer advocates say there is an obvious conflict when doling out financial advice. Instead of helping prospective customers maximize wealth, advocates say builders' advisors could be trying to suck as much money as possible out of buyers' pockets.

"What it does is create a captive consumer where the builder can charge a lot more," said Douglas Miller, executive director of Consumer Advocates in American Real Estate, a nonprofit.

Homebuilders are often helping buyers get government-backed loans that require no down payment, or a low down payment, so taxpayers could be on the hook if buyers can't repay their mortgages. Some consumer experts fear that, just five years after the biggest housing meltdown in generations, builders are up to their old tricks again.

"You have people applying for loans that there's no way they can pay, but it doesn't matter because the ability to repay isn't the basis of the loan. It's the ability to pass underwriting so the loan can be sold," says Washington, D.C.-based bankruptcy attorney, Brett Weiss.

Builders say they are putting people in homes they can afford and helping them achieve their dreams. Most loans that banks are underwriting now meet stringent government standards.

For buyers with enough cash and income, buying a home can lower monthly housing costs because mortgage rates are at record lows and rents are surging. Monthly mortgage costs are lower than rent in nearly every major U.S. metro area now, according to John Burns Real Estate Consulting.

CALL WHENEVER YOU NEED TO

Last year, executives at PulteGroup found that nearly 90 percent of younger buyers wanted to own a home. They loathed throwing away money on rent each month.

"The dream of American home ownership has not died at all," said Pulte Vice President of marketing Fred Ehle. "It was somewhat of a surprise to us."

But Gen X and Yers also had reservations about buying so soon after watching the housing market crash and burn. They also feared they would not qualify for a mortgage.

Just five years after the biggest housing meltdown in generations, that's led some consumer experts to fear that builders are up to their old tricks again.

The number of people aged 25-to-34 who bought homes in 2011 fell to 27 percent, the lowest share in the past decade, according to the National Association of Realtors. Rising student debt has played at least some role in that decline, analysts said. According to the U.S. Consumer Financial Protection Bureau, about 50 percent of young people that started college in 2003 were paying more than 10 percent of their income on student debt.

In response, Pulte launched a mortgage advisor program, whose members are buying houses at twice the rate of prospective purchasers who do not participate.

The advisors hand-hold customers through the entire home process, from picking the floor plan to arranging the mortgage to taking as many calls as necessary to assuage fears.

"I could call whenever I needed to with whatever I needed," says program member Erin Shafer, a 23-year-old school teacher who is buying a new home, along with her fianc?, in Woodstock, Illinois.

The couple have student debt, but they had enough for a down payment due to a relative's recent death. Pulte is giving them $5,000 for closing costs, $3,000 worth for free appliances and a mortgage.

THE INCUBATOR

The Clarks thought they would remain renters forever. But early in the summer, a friend recommended that they meet with Janet Backman, a grandmotherly sales agent for Southern Homes.

During that first meeting, Backman pored over the Clarks' financials and decided to put them in what she calls her "Incubator."

That's the process Backman uses to convert the credit-challenged into home buyers within a matter of months. It drives her crazy that people in her area pay more to rent then to own.

The Clarks had no credit cards and paid for everything with cash. So as Backman talked with them that first day, she simultaneously signed them up for credit cards on the Capital One website.

Then she told the couple that, if they made $50 worth of purchases each month, but only paid the balance down to $25, their credit scores would likely rise immediately.

Within a month, Backman got the couple's scores up enough to qualify for the zero-down government-backed loan she secured for them through a partner lender.

Southern Home's sales agents have sold 162 homes so far this year, with nearly all getting similar advice and loan terms.

Says Backman: "Every time I hear about how hard it is to purchase a home, I'm thinking, what planet are they living on?"

Washington, D.C. - A study presented at the American Academy of Otolaryngology - Head & Neck Surgery Foundation Annual Meeting in Washington, D.C. shows that the MD Hearing Aid line offers a reasonable low-cost solution to those who are not using hearing aids or other amplification devices because of cost concerns.

In the study, researchers at the Michigan Ear Institute sought to evaluate a novel, inexpensive (under $200.) over- the-counter hearing aid regarding to its acoustic properties and also to test the hearing aid on patients with varying levels of hearing loss to evaluate their perceived benefit by using validated questionnaires.

Hearing loss affects approximately 34 million people in the United States, but hearing aid usage rates have historically remained at just 24%. One major reason for this low rate of use is that hearing aids are typically very expensive, with the average cost of a single hearing aid approximately $1,900. Medicare and most insurance companies do not cover this cost. Many medical studies have linked untreated hearing loss in the elderly with a higher risk of social isolation, depression, anxiety, and symptoms consistent with Alzheimer's dementia.

The MDHearingAid was evaluated using a Fonix 6500c Hearing Aid Analyzer, measured according to accepted standards. The measurements included saturated sound pressure level curve, high-frequency average full-on gain, frequency response, total harmonic distortion, equivalent input noise level, and input-output curve. Then the device was tested on a group of participants with mild to moderately-severe hearing loss who were unwilling or unable to purchase a custom hearing aid due to cost considerations. The participants were asked to wear the device for a minimum of 30 days and complete these self-reported surveys: "International Outcome Inventory - Hearing Aids" and "Satisfaction with Amplification in Daily Living".

Researcher Seilesh Babu, M.D. found that the MDHearingAid met the acoustic targets. All participants demonstrated user satisfaction scores that were within the standard range for patients with mild to moderately-severe hearing loss. The study found that the low-cost MDHearingAid is electroacoustically adequate and a reasonable low-cost solution to meet the needs of those value- and cost-conscious patients who were not using amplification via a custom hearing device.

Dr. Babu stated that further development and investigation of these instruments is warranted, to provide a potential opportunity for greater numbers of persons with hearing loss to have access to hearing aids and reap the medical, social, and emotional benefits from improved communicative abilities.

The Winds of Change: More Master Data Management Projects ...

Master data management projects are significantly more successful than four years ago, according to a recent CIO UK column. But when they fail, it?s for the same old reasons: internal politics and poor data quality.

The Information Difference, a UK-based market research firm, recently surveyed companies on their MDM adoption, modeling the questions closely after a 2008 survey on the same topic.

In 2008, MDM actually had a pretty unimpressive success rate, with large companies reporting that their MDM implementations were ?broadly successful? just 54 percent of the time.

Now, that number is 81 percent, reports Andy Hayler, president and CEO of the Information Difference.

But what hasn?t changed is what causes MDM to fail.

?The major barriers to success in MDM have not changed: internal politics and poor data quality were the most commonly cited issues,? Hayler writes.

Of course, those aren?t the only reasons MDM still nets a nearly 20 percent fail rate.

Manjeet Singh Sawhney, a senior Information Management consultant at the London-based Tata Consultancy Services, recently wrote a post outlining 10 other reasons MDM projects fail.

Some of the list you?ve no doubt heard previously, for example ?ignoring the need for business governance.? However, most of it is an interesting blend of hard tech and soft people issues:

  • Only staffing the MDM project with technology people
  • Being unprepared for organizational changes to business processes
  • Neglecting security requirements
  • Ignoring agile development principles
  • Forgetting to patch, fix and enhance the MDM system

The full post is worth a quick read, but you might want to spend some time exploring this excellent site. The ?recent posts? list alone could keep me reading for an hour.

Save Time And Money With Good Learning Management Systems ...

Learning management systems are software that uses web technology to enable you plan, evaluate and execute definite learning procedures. These systems equip a tutor with a platform through which to develop content and disseminate material to students, monitor their performance and gauge their participation in programs. The management systems also enable students to communicate effectively with each other and their tutors as well as participate in forum groups and push towards their learning goals effectively.

By using Learning management systems (LSM), a tutor can easily track the progress of students, know who got what training and when, and thus manage teaching effectively. A superb system is able to gauge the performance of students, automatically test them and evaluate whether they are getting the knowledge they require. Moreover, by suing a secure toolset, you will be able to protect individual training materials and sensitive files from damage and getting into unauthorized hands.

When the software is good enough, it will enable you to retain records of your students, evaluate their progress and know whether your investment is worthy. That way, you will know the areas of training that you need to improve on so that your learners can get maximum benefits. It is important to note that, with the advent of technology, training management systems nowadays support multimedia and interactivity, thus making learning to be more interesting and effective. By using facilities such as E-learning software, you will be able to save money and time spent going to classroom. Moreover, you will be able to study for flexible hours and from wherever you want. It is quite cheap to operate learning management systems when you use the correct approach and have all the necessary tools at your disposal.

You can evaluate a number of things to know whether an LMS is good enough before getting one. One of the important things to do is go for a system that is quite easy to operate. A very complex LMS might complicate your teaching job. In addition, the system should be easy to install without programming. Reliable learning management systems should have features that enable it to collect documents and facilitate their viewing online. Possessing a LMS that supports features such as streaming video, flash and audio facilities would be an added advantage to you, since you will be able to disseminate learning material effectively.
